TERMS OF USE
Terms of Use
Effective Date: August 5, 2026
These Terms of Use (the “Terms”) govern your access to and use of CJAJJ.com and any related pages, member portals, forms, scheduling tools, instructional materials, and online services operated by CJ American Jiu Jitsu (“CJAJJ,” “we,” “us,” or “our”) (collectively, the “Website”).
Please read these Terms carefully. By accessing or using the Website, creating an account, submitting a form, scheduling a lesson, purchasing a product or service, or clicking a button indicating your agreement, you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree to these Terms, do not use the Website.
1. Eligibility and Authority
You must be at least 18 years old and legally capable of entering into a binding agreement to create an account, make a purchase, schedule training, sign a waiver, or otherwise enter into an agreement through the Website.
If you act for a minor, family member, business, or other person or entity, you represent that you have the legal authority to act on that party’s behalf. A parent or legal guardian must create and manage any dependent profile for a minor, submit the minor’s information, approve bookings, and sign all required agreements for the minor. Children under 13 may not create their own accounts or independently submit personal information through the Website.
2. Accounts and Account Security
Certain Website features may require an account. You agree to provide accurate, current, and complete information and to update it when necessary. You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring through your account, including activity involving dependent profiles connected to it.
You may not share your account with an unauthorized person, impersonate another person, create an account using false information, or access another person’s account without permission. Notify us promptly through our Contact Page at https://cjajj.com/contact if you believe your account has been accessed or used without authorization.
We may require identity, parental authority, or account-ownership verification before changing account information, releasing records, or restoring access. We may suspend, restrict, or close an account when reasonably necessary to protect CJAJJ, our members, other users, or the security and integrity of the Website.
3. Website Information and Availability
We make reasonable efforts to keep Website information accurate and current, but we do not guarantee that all descriptions, schedules, instructor listings, prices, availability, rank records, attendance records, or other content will always be complete, current, or error-free. Class schedules, instructors, services, pricing, operating hours, and availability may change.
A displayed opening, appointment time, class, event, product, or service is not guaranteed until any required confirmation, payment, waiver, and other conditions have been completed. We may correct errors, update information, cancel or reschedule services, limit availability, or refuse a transaction when reasonably necessary. If we cancel a paid service before it is provided, any refund or credit owed will be handled under the policy or agreement applicable to that purchase.
We may modify, interrupt, suspend, or discontinue any Website feature. We are not responsible for delays or failures caused by maintenance, third-party providers, Internet outages, events outside our reasonable control, or other technical issues.
4. Memberships, Bookings, Purchases, and Payments
The Website may allow you to request or purchase memberships, private lessons, classes, events, merchandise, or other products and services. Additional terms may be presented at checkout, during booking, in a membership agreement, or in another written policy. Those additional terms are incorporated into these Terms by reference once you accept them.
You agree to pay all prices, fees, and applicable taxes disclosed before purchase. You authorize CJAJJ and its payment processors to charge the payment method you provide for the amounts and on the schedule you approve. We will not treat a payment method dispute or chargeback as a valid cancellation request. Membership cancellations, recurring-payment changes, refunds, credits, expiration dates, and missed-appointment consequences are governed by the specific policy or agreement applicable to the transaction.
Submitting a booking request does not guarantee an appointment. A booking is confirmed only when the Website or CJAJJ provides confirmation and all stated requirements have been satisfied. You are responsible for reviewing the date, time, location, participant, and service shown in the confirmation and promptly reporting any error.
Payments may be processed by third-party service providers. Their terms and privacy practices may also apply to the information you submit directly to them. CJAJJ does not receive or store every piece of payment-card information handled by a third-party processor.
5. Training Participation, Health, and Safety
American Jiu Jitsu, grappling, martial arts, strength and conditioning activities, and related training involve physical contact and risk of injury. Website content is provided for general educational and administrative purposes and is not medical advice, a medical evaluation, or a determination that any person is fit to train.
Consult an appropriate healthcare professional regarding medical conditions, injuries, pregnancy, medications, physical limitations, or other concerns that may affect safe participation. Do not use Website content to diagnose or treat a condition or to disregard professional medical advice. In an emergency, contact emergency services rather than using the Website or our Contact Page.
Accessing the Website, creating an account, paying a fee, or booking a service does not by itself authorize participation. Before training, each participant must satisfy CJAJJ’s then-current eligibility, payment, conduct, equipment, health, and safety requirements and must complete any required participant agreement, informed-consent form, assumption-of-risk agreement, or release and waiver of liability.
These Terms do not replace any separately signed waiver, membership agreement, event agreement, or facility rule. If these Terms conflict with a separately accepted agreement concerning training participation, injury risk, payment obligations, or membership, the more specific agreement will control for that subject.
6. Minors and Dependent Profiles
A parent or legal guardian is responsible for determining whether a minor may use the Website or participate in CJAJJ activities. The parent or guardian must provide accurate information, disclose information requested for safety or administration, sign all documents requiring adult consent, and comply with all rules applicable to the minor.
Creating a dependent profile does not establish guardianship or prove legal authority. We may request reasonable verification and may refuse or pause a minor’s registration or participation if authority, consent, safety information, or custody-related instructions are unclear or disputed.
7. Member Records
The Website may display profile details, membership status, attendance, training hours, belt rank, stripes, promotion dates, documents, or similar records. These features are administrative conveniences and are not guaranteed to be official competition, certification, employment, educational, or legal records.
If you believe a record is inaccurate, contact us through our Contact Page at https://cjajj.com/contact. We may review supporting information before making a correction. CJAJJ retains reasonable discretion over internal attendance standards, rank records, promotion decisions, and the interpretation of academy records.
8. Instructional Content
Videos, lesson plans, demonstrations, articles, images, and other instructional materials are educational resources only. Martial arts techniques can cause injury if performed incorrectly, without proper supervision, or in inappropriate circumstances. Access to instructional content does not replace qualified in-person instruction, coaching, supervision, or the need to train responsibly with a consenting partner.
Member-only or purchased instructional content is licensed to the authorized user for personal, noncommercial viewing. Unless we give prior written permission, you may not record, download, reproduce, republish, sell, distribute, publicly display, share login access to, or use such content to create a competing product or service. Any permitted access ends when the applicable license, purchase right, or membership ends, except where we expressly state otherwise.
9. Acceptable Use
You agree not to misuse the Website. Prohibited conduct includes:
- Violating any applicable law or another person’s rights;
- Submitting false, fraudulent, misleading, threatening, abusive, defamatory, obscene, or unlawful material;
- Attempting to gain unauthorized access to an account, server, database, restricted content, or other system;
- Interfering with the Website’s operation, security, or availability;
- Introducing malware, harmful code, automated scraping tools, or unreasonable traffic;
- Copying, harvesting, or using member or visitor information for unauthorized purposes;
- Circumventing access, payment, or security controls;
- Using the Website or its content to compete with CJAJJ through unauthorized commercial exploitation; or
- Helping another person engage in prohibited conduct.
We may investigate suspected misuse and preserve or disclose relevant information when reasonably necessary to protect rights or safety, enforce agreements, comply with law, or respond to valid legal process.
10. Intellectual Property
The Website and its content—including text, photographs, graphics, logos, branding, videos, course materials, page designs, software, and compilations—are owned by CJAJJ or used with permission and are protected by applicable intellectual-property laws.
Subject to these Terms, CJAJJ grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Website for its intended personal purposes. No ownership interest is transferred to you. Except as permitted by law or expressly authorized in writing, you may not copy, modify, reproduce, publish, distribute, sell, license, reverse engineer, create derivative works from, or commercially exploit the Website or its content.
CJ American Jiu Jitsu, CJAJJ, associated logos, and related branding may not be used in a way that suggests sponsorship, endorsement, affiliation, or authorization without prior written permission.
11. Information and Materials You Submit
You retain ownership of original material you submit through the Website. You grant CJAJJ a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, and use that material only as reasonably necessary to operate the Website, administer your account, provide requested services, maintain business records, protect users, and comply with law.
You represent that you have the right to submit the material and that our permitted use will not violate another person’s rights. Do not submit confidential information that the applicable form does not request. Messages sent through the Website do not create an attorney-client, medical-provider, therapist-client, or other professional relationship.
12. Privacy
Our collection and use of personal information are governed by our Privacy Policy, as updated from time to time. By using the Website, you acknowledge that information will be handled as described in that policy.
Parents and guardians should review the Privacy Policy before creating a dependent profile or submitting information about a minor. A minor should not independently provide personal information through the Website.
13. Third-Party Services and Links
The Website may contain embedded videos, maps, payment tools, scheduling tools, social-media features, links, or other services operated by third parties. CJAJJ does not control and is not responsible for third-party content, availability, security, terms, or privacy practices. A link or integration does not necessarily mean that CJAJJ endorses the third party.
Your use of a third-party service is governed by your agreement with that provider. You are responsible for reviewing the provider’s applicable terms and privacy disclosures.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the Website and its content are provided on an “as is” and “as available” basis. CJAJJ disclaims all warranties not expressly stated in a written agreement, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
We do not warrant that the Website will be uninterrupted, secure, error-free, compatible with every device, or free of harmful components, or that Website content will produce any particular athletic, competitive, fitness, financial, or other result. Some jurisdictions do not allow certain warranty exclusions, so part of this section may not apply to you.
15. Limitation of Liability
To the fullest extent permitted by law, CJAJJ and its owners, officers, employees, instructors, contractors, agents, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Website, including loss of data, loss of access, lost profits, or business interruption.
To the fullest extent permitted by law, the total liability of CJAJJ and the parties listed above for all claims arising from or related to the Website will not exceed the greater of:
- The amount you paid directly to CJAJJ through the Website for the specific product or service giving rise to the claim during the six months before the event giving rise to liability; or
- One hundred U.S. dollars ($100).
This section applies only to the extent permitted by law. It does not exclude or limit liability that cannot lawfully be excluded or limited. Claims relating to physical participation in training may also be governed by a separately signed participant agreement or waiver.
16. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless CJAJJ and its owners, officers, employees, instructors, contractors, agents, and affiliates from third-party claims, damages, judgments, liabilities, costs, and reasonable attorneys’ fees arising from your unlawful misuse of the Website, your material violation of these Terms, material you submit, or your infringement of another person’s rights.
This obligation does not require you to indemnify any person for conduct for which indemnification is prohibited by law.
17. Suspension and Termination
We may suspend or terminate your Website access if you materially violate these Terms, misuse the Website, create a security or safety risk, fail to pay an amount when due, or engage in conduct that reasonably threatens CJAJJ, its members, or others. When practical, we may provide notice or an opportunity to correct the issue, but we are not required to do so when immediate action is reasonably necessary.
You may stop using the Website at any time. Closing an online account does not automatically cancel a membership, recurring payment, booking, purchase, or other agreement. Those obligations must be changed or canceled under the terms that specifically apply to them.
Sections that by their nature should continue after access ends—including provisions concerning payments owed, intellectual property, disclaimers, liability, indemnification, governing law, and dispute venue—will survive termination.
18. Changes to These Terms
We may revise these Terms by posting an updated version on the Website and changing the Effective Date above. Changes apply prospectively from the date posted unless a later date is stated. When required by law, or when a change materially affects an existing paid service, we will provide any additional notice or request any additional consent that is required.
Your continued use of the Website after revised Terms take effect constitutes acceptance of the revised Terms. If you do not agree to a revision, stop using the Website and follow any applicable process to address an existing membership, booking, or purchase.
19. Governing Law and Court Venue
These Terms and any dispute arising from or related to the Website, a booking or purchase made through the Website, or your relationship with CJAJJ are governed by the laws of the State of Missouri, without regard to conflict-of-law principles.
Any lawsuit, action, or court proceeding arising from or related to these Terms, the Website, a booking or purchase made through the Website, or your relationship with CJAJJ must be brought exclusively in a state court of competent jurisdiction located in Jasper County, Missouri. If a claim is subject to exclusive federal jurisdiction, it must be brought in the United States District Court for the Western District of Missouri, Southwestern Division, which serves Jasper County. Each party consents to personal jurisdiction in those courts and waives any objection based on improper venue or an inconvenient forum.
Nothing in these Terms prevents either party from seeking relief in an appropriate small claims court located in Jasper County, Missouri when the claim qualifies for that court.
20. General Provisions
These Terms, together with any additional terms or policies that you accept for a particular service, form the agreement between you and CJAJJ concerning your use of the Website. If a provision of these Terms is found unlawful or unenforceable, it will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.
CJAJJ’s failure to enforce a provision is not a waiver of that provision or the right to enforce it later. You may not assign or transfer your rights or obligations under these Terms without our prior written consent. CJAJJ may assign these Terms as part of a merger, reorganization, sale of assets, change in control, or transfer of Website operations.
Section headings are for convenience only and do not affect interpretation. No agency, partnership, joint venture, employment, or franchise relationship is created by your use of the Website.
